These Terms govern access to and use of MyFavLy during its current free creator MVP and early-access phase.

1. About MyFavLy

MyFavLy is a digital platform that allows creators to build a public storefront where they can organize and share products, services and other recommendations with their audience.

MyFavLy is currently operated by Zoltán Varga as an individual during its initial free testing and validation phase.

2. Current MVP status

MyFavLy is currently in an early-stage MVP and Founding Creator phase. The service is under active development and features may be added, changed, suspended or removed.

The creator service is currently provided free of charge. MyFavLy does not currently charge creators a subscription fee and does not currently take a percentage of commissions earned through creators' own affiliate relationships.

The current free model does not guarantee that all future MyFavLy services or features will remain free.

3. Eligibility and account registration

Creator accounts are intended for adults who are legally capable of entering into agreements under applicable law.

When creating an account, you must provide accurate and current information and keep your login credentials secure.

You are responsible for activity carried out through your account unless unauthorized use is caused by circumstances outside your reasonable control.

Creating an account requires acceptance of the current Terms of Use and acknowledgement of the current Privacy Policy.

4. Creator storefronts

A creator may use MyFavLy to create a profile, add product recommendations, organize recommendations into categories and publish a public MyFavLy storefront.

Creators decide what they recommend and remain responsible for the content, descriptions, statements, links and other materials they submit or publish through their account.

MyFavLy does not endorse every creator recommendation merely because it appears on the platform.

5. Product recommendations

MyFavLy is designed to help creators organize and share recommendations. MyFavLy does not independently test or verify every product or service added by creators.

MyFavLy does not guarantee the quality, authenticity, safety, availability, price, legality, suitability or performance of third-party products or services.

Visitors should evaluate third-party products and retailers before making purchasing decisions.

6. External websites and purchases

Creator storefronts may contain links to third-party retailers, brands, marketplaces or other websites.

When a visitor follows an external link, the visitor leaves MyFavLy and interacts directly with the relevant third party.

MyFavLy is not currently the seller of products displayed through creator storefronts and does not currently process purchases, payments, deliveries, returns or warranties for those third-party products.

Any transaction made on a third-party website is governed by that third party's own terms, policies and commercial conditions.

7. Affiliate links and commercial relationships

Creators may add their own normal product links or affiliate links to their MyFavLy storefront.

A creator's affiliate relationship may exist directly between the creator and a retailer, brand or affiliate network.

During the current MVP phase, MyFavLy does not claim a share of commissions earned through a creator's independently established affiliate relationship.

Creators are responsible for complying with applicable advertising, consumer-protection and affiliate-disclosure rules, as well as the terms of the relevant affiliate program.

Where a recommendation is sponsored, affiliate-based, gifted or part of another commercial collaboration, creators are responsible for making any disclosure required by applicable law.

8. Future monetization

MyFavLy may introduce paid features, affiliate-network integrations, commissions, subscriptions, merchant services, brand partnerships or other monetization models in the future.

Any such commercial model may be governed by updated Terms, additional agreements or separate commercial conditions.

Material changes will be communicated before they become applicable to existing users where required.

9. Creator content and intellectual property

Creators retain ownership of content they lawfully own and submit to MyFavLy.

By submitting content to MyFavLy, you grant MyFavLy a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and technically process that content only as reasonably necessary to operate, display, secure and improve the MyFavLy service.

This licence ends when the relevant content is deleted from the service, except where temporary retention is technically necessary for backups, security, legal compliance or dispute handling.

You must have the necessary rights to any text, images, logos, descriptions or other materials that you upload or publish through MyFavLy.

10. MyFavLy intellectual property

The MyFavLy name, branding, software, website design, application design, platform structure and original materials are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of MyFavLy software, branding or intellectual property to users.

11. Prohibited content and use

You may not use MyFavLy to:

• publish or promote unlawful content;
• publish fraudulent, deceptive or deliberately misleading information;
• impersonate another person, creator, retailer, brand or organization;
• upload or publish content that infringes intellectual-property, privacy or other third-party rights;
• promote products or activities that are unlawful in the relevant jurisdiction;
• distribute malware, malicious code or content intended to compromise users or systems;
• attempt to gain unauthorized access to MyFavLy accounts, software, databases or infrastructure;
• scrape, overload or automate access to the service in a manner that materially disrupts or abuses the platform;
• use MyFavLy in a manner that violates applicable law or the rights of others.

12. Content moderation

MyFavLy may review content when it is reported, when a potential violation is identified or when review is reasonably necessary for security, legal compliance or enforcement of these Terms.

Depending on the circumstances, MyFavLy may leave content unchanged, request clarification, restrict visibility, remove content, suspend functionality or suspend or terminate an account.

Moderation decisions are currently primarily reviewed by a person. MyFavLy does not currently use a fully automated algorithmic system to make final decisions about removal of creator content.

Restrictions will be applied in a manner intended to be reasonable and proportionate to the relevant issue.

13. Reporting content

Anyone may report potentially illegal, infringing, fraudulent, misleading or otherwise prohibited content through the MyFavLy reporting mechanism available on public creator storefronts.

Reports should identify the relevant content or URL, explain the reason for the report and be submitted in good faith.

MyFavLy may review the report, request additional information and take appropriate action based on the circumstances.

14. Suspension and termination

MyFavLy may restrict, suspend or terminate access where reasonably necessary, including for serious or repeated violations of these Terms, unlawful activity, security risks, abuse of the service or infringement of third-party rights.

Where appropriate and legally required, MyFavLy will provide affected users with information about the reason for a restriction or moderation decision.

Creators may stop using MyFavLy at any time and may use the available account-deletion functionality to request permanent deletion of their account.

15. Availability of the service

MyFavLy is currently an early-stage service and is provided on an as-available basis.

We do not guarantee uninterrupted or error-free operation. Temporary interruptions may occur because of maintenance, technical problems, third-party infrastructure, security incidents or service changes.

16. No guarantee of earnings or results

MyFavLy does not guarantee sales, commissions, income, audience growth, traffic, brand collaborations or any other business result.

Creators remain responsible for their own commercial, tax, advertising and affiliate obligations.

17. Analytics

MyFavLy may measure basic storefront activity, including storefront views and outbound product clicks, to provide platform functionality, creator analytics and service administration.

Details about the personal data and technical information processed by MyFavLy are described in the Privacy Policy.

18. Third-party infrastructure

MyFavLy relies on third-party infrastructure and service providers for functions such as hosting, deployment, email delivery, domains and mobile application distribution.

External services may be subject to their own terms and privacy policies.

19. Limitation of responsibility

To the extent permitted by applicable law, MyFavLy is not responsible for losses caused solely by third-party retailers, external websites, creator statements or circumstances outside MyFavLy's reasonable control.

Nothing in these Terms excludes or limits liability or legal rights that cannot lawfully be excluded or limited.

20. Privacy

Processing of personal data in connection with MyFavLy is described separately in the MyFavLy Privacy Policy.

The Privacy Policy forms an important part of the information provided to users when they create or use a MyFavLy account.

21. Changes to these Terms

These Terms may be updated as MyFavLy develops, including when features, legal requirements, the operating entity or the commercial model changes.

Each version will carry an effective version date. Where a material change requires renewed acceptance, MyFavLy may require users to accept the updated Terms before continuing to use relevant parts of the service.

22. Governing law

These Terms are governed by applicable Romanian law, together with directly applicable European Union law.

Mandatory legal protections and rights that apply under Romanian or European Union law remain unaffected.

This email address may be used by users for direct communication regarding accounts, content reports, legal matters and the operation of MyFavLy.

Romanian and English may be used for communications concerning the service.

Notă pentru creatorii din România

MyFavLy se află în prezent într-o etapă MVP și Founding Creator. Utilizarea platformei de către creatori este în prezent gratuită.

Creatorii își pot crea propriul storefront, pot organiza recomandări de produse și pot utiliza linkuri normale sau propriile linkuri affiliate.

În această etapă, MyFavLy nu percepe abonament de la creatori și nu reține un procent din comisioanele obținute prin relațiile affiliate independente ale creatorilor.

Creatorii sunt responsabili pentru conținutul publicat și pentru respectarea obligațiilor aplicabile privind publicitatea, transparența colaborărilor comerciale și linkurile affiliate.

Conținutul potențial ilegal, fraudulos, înșelător sau care încalcă drepturile altor persoane poate fi raportat prin mecanismul de raportare disponibil pe MyFavLy.
